Regulations for the provision of services electronically the system "UKTRUCKCHECK" operating in the domain of the website www.UKTRUCKCHECK.COM

DEFINITIONS OF TERMS USED IN THE REGULATIONS:

Rules and Regulations – these rules and procedures for the use of services provided by road
electronically within the scope of the service portal operating the electronic version of the checklist, referred to hereinafter and on the website as the “Terms and Conditions for Electronic Services” or alternatively as the “Terms and Conditions for E-services”.

Client – a company that uses the services provided electronically by the Service Provider. When registering an Account, the Client accepts the Terms and Conditions and thereby confirms that he/she has read the Terms and Conditions and agrees to all the provisions of the Terms and Conditions. In addition, the Client declares that he concludes the Agreement within the framework of and in connection with his business activity, it has a professional character for him, resulting in particular from the subject of his business activity. The User, who registered the Account and proceeded to the process of authorisation of this Account under the terms of the Terms and Conditions, is entitled to represent (e.g. as a proxy) the Service Recipient, at least to make declarations of knowledge and will towards the Service Provider and may contact the Service Provider on behalf of the Service Recipient in all matters related to the UKTRUCKCHECK System.

UKTRUCKCHECK system – a system of co-operating software modules, IT resources, operating on the ICT infrastructure administered by the Service Provider, providing for the processing and storage as well as sending and receiving data via telecommunications networks by means of a telecommunications terminal device appropriate for the type of network (e.g. laptop, telephone).

Account – a set of resources in the UKTRUCKCHECK system, marked with an individual name (login) and password provided by the Customer, in which the Customer’s data made available in the process of creating an account and as a result of the use of the system are stored. The Service Provider reserves the right to intervene in the technical structure of the Account and Derivative Accounts in order to diagnose malfunctions of the UKTRUCKCHECK System, and may make changes and in any other way interact with the technical side of the Account and Derivative Accounts in order to modify them or restore their proper functioning.
Derivative Account – a set of resources in the UKTRUCKCHECK system, marked with an individual name (login) and password provided by the Customer, in which the data of an individual (e.g. a driver) made available in the process of account creation and as a result of the use of the system are stored. Actions and omissions, in particular those resulting in a breach of the Terms and Conditions, made from the Derivative Account shall be the full responsibility of the Service Recipient. The user of the Derivative Account acts for and on behalf of the Service Recipient within the meaning of Article 97 of the Civil Code.


Login – a sequence of letter, digital or other characters identifying the User as a user
an established account.

Password – a sequence of letter, digital or other characters protecting and allowing access to the
a specific account with a login assigned to it.

Information bulletin (newsletter) – sent electronically (to the e-mail address indicated by the Customer
e-mail address) information about changes to the UKTRUCKCHECK system and related information intended for the Service Recipient

Period of authorised use – this is the period during which all amounts owed by the Client to the Service Provider are settled and access to the UKTRUCKCHECK system is paid for,

Checklist – A checklist generated in the system for a single border crossing

 

CHAPTER I: General Provisions

 
  1. These Regulations set out the rules for the use of services provided electronically under the UKTRUCKCHECK system operating under the UKTRUCKCHECK.COM domain.
  2. In connection with the provision of electronic services using the website, the Service Provider uses software and coding technology to ensure the security, confidentiality, privacy and integrity of the transmitted data/information.
  3. In order to ensure adequate protection from the dangers arising from the connection to the Internet in connection with the provision of electronic services, Service Recipients are advised to use appropriate protection software on their computer equipment, among other things. against viruses, worms, including other software that performs actions unintended by the Service Recipient and causing threats related to the provision of electronic services.
  4. The services provided electronically by the Service Provider are fee-based.
  5. Payment for the use of the system is made once a month using the UKTRUCKCHECK payment system operated by przelewy24.pl.
  6. The Service Provider is not responsible for the accuracy and truthfulness of the content entered by the Service Recipient.
  7. The Service Provider is not responsible for material losses resulting from improper, unlawful use of the UKTRUCKCHECK system or its individual functions.
  8. The Customer is obliged to report malfunctions of the UKTRUCKCHECK system through the UKTRUCKCHECK contact form or to the contact details of the Service Provider.

 

CHAPTER II: Types and scope of services provided electronically under the UKTruckCheck system.

 
  1. The Service Provider under the UKTRUCKCHECK system provides electronic services consisting of:
    1. maintaining an account in the UKTRUCKCHECK system,
    2. Enabling the entire process involved in handling the electronic version of the checklist,
    3. billing of fees for the use of services, according to the current price list available at www.uktruckcheck.com, based on the data entered into the UKTRUCKCHECK system by the Service Recipient,
    4. Entering data into the UKTRUCKCHECK system provided by the Customer,
    5. subscription to the newsletter i.e. sending current information about changes related to the services offered by the Service Provider to the e-mail address indicated by the Clients.
  2. During the period of authorized use of the UKTRUCKCHECK System by the Customer, the Service Provider grants the Customer a limited, non-exclusive and non-transferable license to access the UKTRUCKCHECK System and to create the necessary records documenting the inspection of the vehicle (set of vehicles) during the transit to the UK in quantities consistent with the purchased license package. Except for the limited license so specified, you do not obtain any other right, title or interest in the UKTRUCKCHECK system.
  3. The Customer undertakes to use UKTRUCKCHECK.COM, including all related services and functions, in accordance with the applicable rules and laws, having regard to, among others. That it is prohibited for the Customer to provide unlawful content, also observing other applicable restrictions on the use of the site and its content. The recipient undertakes:
    1. not save, download, reproduce, distribute, modify, display, reproduce, publish, license, sell or exploit the content and information contained in or obtained through the site
    2. through (unless expressly permitted in these Terms), nor create derivative works based on such content.
    3. Do not circumvent, remove, modify, disable, weaken, or disable the security features of the content on UKTRUCKCHECK.COM; do not use “robot,” “spider,” or “scraper” programs or other automated means to access UKTRUCKCHECK.COM; do not decompile, reverse engineer, or disassemble software or other products or processes accessible through UKTRUCKCHECK.COM
    4. not to introduce any additional code snippets or products, or modify the content on UKTRUCKCHECK.COM; or use any data extraction, mining or collection methods.
    5. not post, publish, email or transmit any material that may disrupt, disable or limit the functionality of any computer software or hardware or telecommunications equipment associated with UKTRUCKCHECK.COM, such as viruses or other computer code, files or programs.

In case of violation of the provisions of these Terms and Conditions by the Service Recipient or illegal use of the UKTRUCKCHECK system, we reserve the right to disable or restrict such Service Recipient’s access to the UKTRUCKCHECK system.

 

FAMILY III: Technical requirements necessary for cooperation with the ICT system used by the Service Provider

  1. The use of services by electronic means, provided within the framework of the UKTRUCKCHECK system is possible after the recipients’ ICT system meets the following technical requirements:
    1. Checklist management panel (administrator)
      1. Personal computer with Internet connection
      2. Current web browser (Edge, Chrome, Firefox or Safari)
      3. Active e-mail address
    2. Filling out the checklist (driver)
      1. Cell phone with Android 9 or higher or iOS 14 or higher
      2. Internet access to download checklist details and upload completed items to the cloud
      3. Active cell phone number
      4. Current web browser

 

Chapter IV: Terms and conditions for creating an account in the UKTRUCKCHECK system as part of the service provided electronically.

  1. As part of the services provided electronically, Service Recipients have the opportunity to create an account, the functionality of which is to administer and manage the data entered into the UKTRUCKCHECK system.
  2. The Service Provider, within the framework of the established account, provides services directly managed by the Service Recipient, namely:
    1. driver and car management service
    2. service for creating and sending checklists to the driver
    3. checklist checkpoint service sent by drivers on a regular basis
    4. driver viewing service
    5. service of creating electronic version of checklist in PDF format
    6. password update services,
    7. services to update the data entered by the Customer.
  3. Access to your UKTRUCKCHECK account is password-protected, whereby:
    1. The password for the system must consist of at least 8 characters,
    2. The password must contain at least one capital letter, at least one number, and at least one special character,
    3. UKTRUCKCHECK system allows you to change your password at any time after logging into the system,

 

Chapter VI: Terms and conditions for termination of the contract for the provision of electronic services in the UKTRUCKCHECK system.

  1. The customer may terminate the contract by sending an appropriate statement to the e-mail address: hello@uktruckcheck.com 2 weeks before the end of the billing period, unless the individual contract has a different provision.

 

Chapter VII: Complaint procedure

  1. The Service Provider shall take the necessary actions for the proper and fully correct operation of the UKTRUCKCHECK system to the extent that results from the current technical knowledge, including information technology, and undertakes to remove all irregularities reported by the Service Recipients.
  2. Complaints related to the provision of electronic services through the website may be submitted by the Customer by sending an e-mail to the Service Provider’s e-mail address.
  3. In the email mentioned in item. 2 provide as much information and circumstances as possible about the subject of the complaint, including the details of the Customer (phone number, e-mail address) and
    Indication of the date of occurrence of irregularities.
  4. The service provider will respond to the complaint immediately, no later than within 14 days. The response to the complaint is sent to the e-mail address provided by the Customer.

 

Chapter VIII: Purpose and scope of processing of personal data of individuals using services provided electronically in the UKTRUCKCHECK system.

  1. In connection with the conclusion and subsequent performance of the contract for the provision of services under the UKTRUCKCHECK system, the Service Provider processes the necessary personal data of the Service Recipients, the scope of which is determined by the provisions of the Act of 18 July 2002 on the provision of services by electronic means.
  2. The data referred to in item. 2, include:
    1. Name of contact persons,
    2. TIN, KRS, REGON data, contact details of the Service Recipient and customers,
    3. email address,
    4. contact phone number
    5. Name and phone numbers of drivers who receive checklists
    6. Names and surnames, telephone numbers and email address, of persons holding sub-accounts established by the Customer
  3. Provision of data referred to in point. 3, is voluntary, however, the Service Recipient accepts that their absence may contribute to the malfunction of the billing and cost estimation services of the UKTRUCKCHECK system.
  4. For marketing purposes, it is possible to process the Service Recipient’s personal data only after
    his consent for this purpose.
  5. Any consent to the processing of personal data is voluntary and can be revoked at any time.
  6. All data for inactive accounts (checklists, driver list, car list) are stored for a maximum of 6 months. After this time, they are irreversibly removed.
  7. The Service Provider undertakes to report within 72 hours of detection to the competent supervisory authority cases of violations that may result in a threat to the rights and freedoms of the persons whose data have been violated.
  8. Personal data contained in the UKTRUCKCHECK system may be deleted in the system at the request of the person concerned.

 

Chapter IX: Contact point

  1. Service recipients can access information about electronic services from the point of contact maintained by the Minister of the Ministry of the Interior. economy at www.biznes.gov.pl.
  2. The point of contact referred to in paragraph 1 shall respond to inquiries from service providers and service recipients in Polish or English on:
    1. The rights and obligations of service providers and service recipients,
    2. Complaint procedures and remediation of damages in the event of disputes,
    3. provide information on relevant bodies, associations, or organizations providing
      Practical assistance regarding electronic delivery of services.

 

Chapter X: Disclaimer of liability

  1. To the maximum extent permitted by law, the Service Recipient acknowledges and expressly accepts that use of the UKTRUCKCHECK System is solely at its own risk and that the UKTRUCKCHECK System is provided “as is” and “as available”, without warranty of any kind, in particular, even correct use of the UKTRUCKCHECK System does not guarantee the avoidance or waiver of penalties imposed by the competent UK authorities. In addition, with problems with the operation of the UKTRUCKCHECK System during transit to the UK, the Service Recipient is aware that this does not waive his obligations to comply with the requirements of the UK authorities (including, for example, the completion of a written checklist).
  2. The Service Recipient uses the UKTRUCKCHECK System at its own discretion and risk. He is solely responsible for any damage caused to the device on which the system is run and for any loss of data resulting from this use.
  3. In addition, Service Provider expressly disclaims its liability for all warranties and conditions of any kind, express or implied, including but not limited to implied warranties and guarantees and conditions of merchantability, fitness for a particular purpose and non-infringement.
  4. To the maximum extent permitted by law, the Service Recipient acknowledges and expressly agrees that the Service Provider, its subsidiaries and affiliates and the licensor shall not be liable to the Service Recipient under any liability rules for any indirect, incidental, special, consequential or punitive damages incurred by the Service Recipient or its subsidiaries and affiliates, including loss of any data .

 

Chapter XI Final Provisions

  1. Provision of services by electronic means referred to in these Regulations shall be made in Polish or English and in accordance with the applicable laws of the Republic of Poland (RP).
  2. Any disputes arising between the Service Provider and the Customer will be submitted to the common court in Gdansk. The legal relationship between the Service Provider and the Client shall be governed by Polish law.
  3. In matters not covered by these Regulations, the regulations shall apply, in particular:
    1. Act of July 18, 2002 on the provision of electronic services,
    2. Law of May 10, 2018. On data protection,
    3. Act of April 23, 1964 Civil Code
    4. Order of the Minister of Economy dated August 17, 2010 on the establishment of a contact point for administration and a contact point for service providers and recipients.
  4. The Service Provider allows the right to amend the provisions of these Regulations for important reasons, in
    In particular, in the case of:
    1. changes to the layout of the website, operating under the UKTRUCKCHECK.COM domain affecting, among other things. on the manner and conditions of providing services electronically,
    2. changes in the scope of applicable laws relating to electronic commerce, including electronically provided services,
  5. Amendments are effective within 7 days of their publication on the website with an indication of the date of publication and validity of the amendments.
  6. The content of these Regulations is available on the Service Provider’s website.
  7. At the request of the Customer, the terms and conditions of the e-services shall be sent in such a way as to enable the Customer to obtain, reproduce and record the content of the terms and conditions by means of the data communications system used by the requesting Customer.
  8. The layout, images, content and descriptions contained in the Service Provider’s pages may not be modified, copied and distributed without the consent of the Service Provider.
  9. The regulations are effective as of December 1, 2022.
